A LETTER TO THE EDITOR REGARDING THE NCHA

AN OPEN LETTER TO ALL NCHA OFFICERS, DIRECTORS AND MEMBERS

THIS DIRECTOR IS LOOKING FOR RESPONSES

 

Glory Ann,

Let me start by saying how much my fellow directors and I appreciate your service in exposing the many negative issues within the NCHA. I could liken your reporting to turning on the kitchen light and watching the roaches scurry to find cover. And while it pains me to have our association’s issues broadcast to the general public, many of us believe it is necessary to expose the incompetence, ignorance, maliciousness, and hypocrisy that is rampant in our association’s “Leaders”, in hopes of rectifying all of the problems, to ensure a healthier organization in the future. Several months ago, I came to the realization that the only way to keep our membership informed of the current state of affairs was to use your website as a venue. Therefore, anytime I glean any knowledge of malfeasance or lack of transparency, I decided to keep you informed, and encourage others to do the same. All too often the president, executive director, and the executive board sweep things under the rug, keep the members in the dark, ignore the wishes and pleadings of members and directors, and go about securing their own personal agenda with a total lack of transparency or accountability. THIS MUST STOP NOW!!! There have been too many issues brought forth and too many questions unanswered for the public to ignore any longer. What was a dull yelp, is now a loud scream! We want answers and accountability! We are posing the following questions to be answered by the NCHA ”Leadership” (on this website) within 7 days, as we can no longer wait and hope for the NCHA to keep us accurately informed:

1. Why did the Dufurrenas receive such a lenient punishment, when the precedent for breaking Non-pro Ownership rules had been lifetime suspensions in the past? Why have lesser infractions of various rules received harsher punishment than fraud perpetrated against fellow competitors and members? Why did they get preferential treatment? Why did MRS. Vogel receive sanctions when Ed Dufurrena’s wife, Shona, who not only had knowledge of, but also participated in the fraud, receive no punishment whatsoever? Why were the Dufurrena’s horses allowed to be shown at the Summer Spectacular, when this clearly is in violation of the rules?

2. Why has Ed Dufurrena not received additional punishment for violating the terms of his suspension not once, but 3 times during the Summer Spectacular? (He was asked to leave the practice pen and flag area twice, including the need of police intervention. Also, a suspended person CAN NOT be the agent for/of a horse in NCHA competition)…See the RULE BOOK!!

3. Why did NCHA President, Phil Rapp, try to sway the opinions of potential grievance board members by lobbying for NO sanctions to be brought against the Dufurrenas prior to NCHA hearings on the matter? Furthermore, why did our President come to the aid of Ed Dufurrena (after he was found guilty of ownership violations) by working his horse, when he was just asked to leave the practice pen? Does our president condone the acts of breaking one of our most sacred rules? How does he think this looks to our membership or general public?

4. Why did our President elect, Ron Pietrafeso comment on allaboutcutting.net that there were no suspension infractions committed by Ed Dufurrena, when he clearly violated the rules three times during the Summer Spectacular? Why did Ron choose to ignore the fact that a formal complaint had been signed and witnessed by a prominent NCHA member? Moreover, why did the Executive committee or grievance committee fail to act on this complaint when they held meetings in the days following the show?

S. Have the titles and awards won fraudulently by the Dufurrenas been stripped, and monies returned by the Dufarrenas and awarded to the rightful winners, or persons who placed under the Dufurrenas? Has the NCHA even recognized the rightful winners? What has been done, if anything, in this regard? What will be done, and when will it be done?–If nothing has been, or will be done to rectify this situation, do our “Leaders” think that paying win monies to the Dufurrenas from their horses showing at the Summer Spectacular is a good idea, in principle? Have our “leaders” adopted the thinking that it is okay not to make reparations to those who were directly damaged by the Dufurrenas’ fraud, and wrongfully allow the Dufurrenas’ horses to be shown (and receive win monies) when they shouldn’t have been allowed to compete in the first place?

6. Why doesn’t the NCHA follow and enforce their own rules, which are set out in the rulebook that is distributed to every member? What’s it going to take to make them follow and enforce these rules? Do these rules only apply to a select few who aren’t part of the “Good ‘ol boy system?” Does the NCHA not understand that by not enforcing rules evenly and fairly, and meting out consistent and fair punishments, that our association is at greater legal risk for litigation and public scrutiny?

7. Does our “Leadership” not recognize that our membership has decreased approximately 50% in the past few years?

8. Is our “Leadership” so ignorant as to think that the Texas Mega Event Trust Fund will continue to give money to an organization that is so poorly run, is in an ongoing economic crisis,is in a constant state of turmoil and strife, has a diminishing membership, and doesn’t adhere to or enforce their own rules? Do our”Leaders”not remember that our state funding was drastically cut in the past due to fraudulent accounting and reporting? Are they so ignorant to think that the METF isn’t looking for an excuse to cut funding and reallocate monies to other, more deserving events and associations? Does “Leadership” not understand that by their own actions and lack thereof, that they are jeopardizing the premier events and taking money out of everyone’s pockets, including their own?!? Do they not understand that other events and associations are lobbying the state for funds, and could use our current state of affairs against us in hopes of receiving monies that should be ours?

9. Does our ”Leadership” not understand the need to lead by example, and set forth an agenda of rightness, integrity, fairness, and intelligence?—Do they not know that for decades the NCHA was an example for all other associations to be judged against? Do they not think we should be demonstrating why cutting is the most exciting equine sport, governed by an association that is comprised of smart, forthright, astute, business minded, forward thinking individuals?

10. Does our “Leadership” not understand that we are in direct competition with every other equine association for membership? And in this competition, do they not understand that they and their poor decisions are giving ammunition to our competitors as why NOT to join the NCHA or cutting industry in general?

11. Does our “Leadership” not grasp the fact that our association is in peril? Is there no recognition that actions need to be taken to restore confidence, repair our reputation, and restore the overall health and solvency of our once great association?

To further validate our concerns, one need only to read on facebook and Allaboutcutting.net, the remarks of past presidents, committee members, and general members, in reference to how they think the NCHA is being run. If all of us can see the disaster our association has become, why can’t our “Leaders”?

It is due to the aforementioned issues and complacency of our ”Leadership” that we are joining the growing list of those calling for the resignation of NCHA President, Phil Rapp. He has demonstrated such poor leadership, and total disregard for our rulebook, in trying to protect the Dufurrenas in their fraudulent behavior. If he chooses not to resign, we implore the Executive committee to impeach him! Furthermore,we are demanding that the NCHA seek and hire a qualified and experienced Executive Director, who has the knowledge, integrity, and fortitude to resurrect our once great association. We’ve heard the term, “Drain the swamp” lately, and it is high time we do it! Our elected and appointed officials MUST do the job they volunteered for, and do it well…or be removed from their position.

As I stated above, WE ALL WANT ANSWERS! What has been written in this letter is not based on hearsay or rumor, but rather, indisputable FACTS! We deserve a full, accurate, and timely response,on this website! As our President Elect has seen fit to comment onAllaboutcutting.net, we take this venue as being endorsed by him and feel that this is the proper venue to finally show the transparency we deeply deserve. If there is no response, we can only conclude that there is guilt and culpability in their silence, and we are once again made aware of their lack of competence or care, in keeping their members informed and serving the greater good of the association. We encourage every member to let their thoughts and opinions be known, and share them on Allaboutcutting.net. Our ”Leaders” must know that we will not go away! We will continue to point out every bad decision, inaction, bad conduct, conflict of interest, act of incompetence, and any act of ignorance demonstrated by our ”Leadership”, no matter who it is or what position they hold. Let’s face it, one doesn’t have to have a PHD to recognize our dire situation, and it’s downright embarrassing!!

Thank you Glory Ann for providing a public forum to reach both our membership and “leadership”! Let’s see if they have enough respect for our membership to fully address ALL of these matters, and provide answers to the questions that shouldn’t have had to be asked!

  2. I’m suspect of letters written like this one when the author doesn’t sign his/her name. Without a “source name” it sounds a little like “Fake News.” I really appreciate your writings because they’re fully documented, referenced and signed by you. The author of this letter needs to step up to the plate and act like a big-league guy! I sincerely want all this to be solved. If it drags on, I’m leaving!

  3. I could not have said it any better. the problem is also that people don’t want their name on this because of what they are afraid will happen to them. I have talked to some trainers and they don’t want to because it’s their livelihood and you can’t blame them Look at what they did to Les Bates. I have wanted to write a letter on just that but am not good at it like that person is You are welcome to put my name on this. thank you for all you do!

  4. Thank you Glory Ann for your courage in raising public awareness of questions and issues facing the NCHA as an association, the membership as a whole and the future of our industry. This most recent letter very clearly identifies the current items on the table and, as I replied to one of your earlier exposes, I agree with what has been presented but I too need to know the justifications of those actions taken most recently in regard to the Dufurrena issue. I have known Phil Rapp for a very long time. I have the highest respect for him as an individual as well as a horseman. I feel certain there is another side to these questions and Phil, as well as Ron Pietrafeso and the executive board, right or wrong, should have an opportunity justify their decisions.

  6. The letter was impressive. It identified the problems those involved and clearly is compassionate about the association members, staff and leadership. The problems will not go away until those in charge, take charge. There is a reason, personal or business, or perhaps a combination that have impacted the judgment of the executive committee. (reminds me of a lot of our national elected officials that do what pleases them for their own betterment, regardless of legality of opposition of those in the “right.” As a lifetime member of the NCHA it is sickening. It is an association run by trainers for their own good. seems there needs to be accountability and at present there is none. Not a proud feeling to be a part of, something that has little or no regard to fairness. It concerns me,, that as well as the letter was written, a person who is afraid to sign his/her name, causes the letter to lose credibility. If they are strong enough to take a stand, they should see who amongst their peers are willing to stand with him/her. Granted, the first step in solving these issues is to identify the problems and then attack it. there is a lot of work to doubt the goal is attainable as long as there is focus and no further deterrents. Violations and punishments must be the same for everyone, NO EXCEPTIONS! Rules are there for a reason. Keep up the good work Glory Ann.

  7. Glory Ann, I address this letter to NCHA membership & hierarchy and to anyone who might benefit from its contents.

    Recently I read a reader’s comment responding to a Kurtz column. The reader wrote anonymously for fear of retaliation. Today I read an impassioned letter from an apparent NCHA Director. He too opts to withhold his identity. What’s wrong with this? Absolutely nothing! In fact it’s the prudent and safe thing to do in our current vicious equine climate.I too, choose to opine with anonymity. Read on.

    After the printing of the Director’s letter, two individuals (I won’t name) quickly responded negatively. These two people excoriated the director for not signing his name to the letter. They did, valiantly attach their names to their comments. What was telling was neither of them gave an opinion on NCHA malfeasance, Dufurrena fraud, etc. What bravado!

    The fear of retribution or payback in the cutting community, absent of paranoia, is a real and possible actuality. And in my opinion, is ongoing and may actually play itself out violently. As I understand, in the not too distant past, and in an equine environment, a frenzied and berserk-like attack occurred. A person on horseback savagely accosted another individual on foot in an attempt to inflict bodily harm or God forbid worse! This involved a member of a prominent cutting horse family. A name you might find in news today. This fear of intimidation, whether political or by physical violence is real!

    Concerning the Dufurrena’s, how did their fate come down to an appeals grievance panel this late in the game? They should have been booted long ago.

    1. They were found guilty of fraud over false advertising of a HERDA Carrier stallion months ago.

    2. They sold a 49% joint venture in a stallion (Auspicious Cat) in 2006. They kept 51%.

    This unscrupulous Ponzi scheme involved tens of thousands of $dollars and negatively impacted a host of victims. Was this ever discussed by the NCHA Committee? What does it take to get life suspension?

    The Director, in his enlightening and forceful letter wrote of a swamp-like atmosphere controlling our Association. As in the bureaus and agencies of all levels of government, we must constantly be on guard against corruption from within. The deep state of cronies, leeches, and parasites are lurking. I fear the NCHA is in a similar position, as the crooks are constantly looking to bilk or game the system.

    As for Phil Rapp, I hope he’ll resign soon; his bias is overwhelming and I don’t think he’ll ever be an effective President. Same goes for you too Ron Petriefeso; your attempted cover up of Ed Dufurrena’s misdeeds was galling and glaring. Time to move forward.

    In ending, I say thanks to unknown Director for your incite in this ongoing charade. I pray for your continued diligence and well-being.

  10. Good morning Glory Ann, As you know from the past I’m not a fan of unsigned letters, I believe if you can’t sign your name don’t say anything, to me that is the cowards’ way. But I feel compelled to answer UNNAMED, because of so many false and untrue statements and the unnecessary demeaning of so many good people who are members of the NCHA. I will attempt to answer these untrue claims in the order they have been presented. I am speaking as an individual longtime member of the NCHA and not as it’s President-Elect or member of the Executive committee. I have not discussed this with anyone before writing it nor have I asked for permission, I am doing this as a member only. I am not answering officially as demanded by UNNAMED.

    What type of person can write to a public forum and call its leaders the crude names, roaches, incompetent, ignorant, malicious hypocrites and then not be brave enough to sign their name? A coward who passes on rumors and untruths that’s who and a person who is afraid of being liable for slander and defamation. Lets start with number 1.

    #1.The Dufurrena’s punishment was decided by a group of peers, members of the NCHA, just like any legal proceeding. The members of both those committees that heard the evidence, I know personally and their integrity and honesty is above and beyond any accusations made by any UNNAMED person. None of us but those on the committee heard all the evidence or any of the testimony. You can disagree all you want with the outcome but without knowing what those committee members knew there is no way to criticise their decisions. I believe in our procedures and if they need to be changed then as a group we need to work on that like we would with any other rule that needs changing. As our rules stand there was no violation in letting Mrs. Dufurrena show her horse. If UNAMED doesn’t like the present rule then come forward and help change it. (Untrue statements by UNNAMED)

    #2. Mr. Dufurrena did not violate any of his suspension at the summer show. When told what the rule was by Phil Rapp and Lewis Wray he left, the officer was asked to be there only as a precaution and he did not escort anyone from the practice pen. He was also not an agent of a horse being shown. (Untrue statements by UNNAMED)

    #3. I have never heard our President Phil Rapp ever say there should have been no sanctions against anyone who had been accused of any violations. Secondly, he did not come to the aid of Mr. Dufurrena, he came to the aid of another NCHA member who needed his horse worked. The horse did NOT belong to Mr. Dufurrena.     #4. There were no violations of Mr. Dufurrena’s probation during the summer show and I have never seen a written complaint by anyone stating a violation had occurred, where is this complaint and who signed it. (Untrue statement by UNNAMED)

    #5 UNNAMED needs to show all of us where in our rule book we have the authority to strip anyone of their title or demand they return any monies won. Again if we need a rule change then UNNAMED should come forward and help us change it. Also show us where in the rule book that says you can deny anyone from showing when they have not already committed and been found guilty of a rule violation. (Untrue statements by UNNAMED)

    #6. UNNAMED needs to be specific on how we are not following the rule book, don’t just make an assertion without being specific. Anyone can do that. (Untrue statement by UNNAMED)

    #7. Of course, we and I’m sure most members realize that our membership has dropped drastically. I have been talking about it for months if not years. Again this didn’t happen overnight and there are many reasons why it has occurred and there are many directors, committee members, volunteers, EC members and employees of the NCHA that are working on ideas to change that. It won’t be fixed overnight. Does UNNAMED even know what is being done, is UNNAMED on any committee or volunteering to help in any way? If your not part of the solution your part of the problem.

    #8. Again cheap defaming comments, I don’t believe any of our leadership is ignorant nor do I believe they don’t care about changing things for the better. They care very much about all of our relationships with the City, the State and any and all that help the NCHA.

    #9. Of course, our leadership understands leading by example and I believe they do their best to show that. We have some of the smartest, most intelligent astute and talented business people I have ever had the pleasure of working with. Take a look at who sits on our finance committee for example or any of our other committees. I dare you to say that isn’t happening with our leadership. This leadership group spends hours and hours in meetings, on 3 & 4 hour conference calls, hours and hours answering emails and telephone calls from members who have concerns or complaints (who always identify themselves) All of this is done on a volunteer basis and many are taking away from their own businesses and families because they do care and want to make a difference. They don’t write anonymous letters of complaint or defamation, they roll up their sleeves and get involved.

    #10. Of course we are in competition with other organizations, always have been and always will be. We need to respect them and I, unlike UNNAMED, believe they respect us and that is based on meetings that I have personally had with some of these other organizations. Many of the people who belong to other horse organizations are competing in both those and ours.

    #11. We have our problems and there are many people working on them, including the EC, the officers, national directors, committee members and other member volunteers. I believe working together we will overcome any obstacles but some may take longer than others. Complaining without suggesting solutions or volunteering only makes you UNNAMED one of the obstacles!!!

    Last but not least you say there is a growing list of people who are calling for our Presidents resignation, please send me that list including your name so I can answer each and everyone of their concerns. Our President like those before him are spending hours and hours of their own time trying to solve the problems. I know this because I am working right along side of him and our other EC members, committee members, our member volunteers and our employees of the NCHA. We all believe we have some challenges but we will keep working to solve as many of them as we possibly can.

  11. Glory: to the anonymous complainer: Every time I complained, questioned, or constructively criticized, I have used my name. Although I mostly agree with these comments, they are not new in principle, just the details of the subject matter. NCHA is more and more like Trump and his new America; the top and well-connected seem to have their way and the rest come along hoping for relief somehow. I have studied Trump for years and read all the books about him, and visited Cyprus and Russia in the early 90’s so I am qualified to say he is the worst individual to ever be elected to any office in the USA, not to mention being outright owned by the oligarchs. But I digress. As a lawyer still in practice after 50 years, I am well-connected but I favor those less so, as I have mine because of them, and never feared fighting windmills for them if necessary. My time is better spent these days fighting Trump but I will endeavor to help this person out, in appropriate fashion, once the identity is known. My first term as a Director, was in the 70’s and Executive Comm. in the early 90’s and my number is 3537, so I have seen a few come and go. Started judging in the 70’s and suggested a form of Casebook and use of judging seminars in a letter to all Directors back then and in a letter to the Editor, Quarter Horse News. I incorporated 3 associations in two states. Been a pro since 1998, coached state and national High School cutters. When I see a name I might have more to say….if you are a guy, Man Up!       I hold nothing against anyone wishing to withhold their names, the NCHA is a Clicky group and people do not want to be singled out when they are trying to make it better. Those in the clicky group can make it really hard for the average Joe.

  13. 1. Why did the Dufurrena’s only receive 150 days suspension, when Bob Bouget and his daughter received 3 years for the same type of non pro violations? As you know this is a precedent previously established by the NCHA? Why the difference?

    2. Why aren’t the Whitmires members when they beat the NCHA in the Texas appeals courts and was ordered to reinstate them. After the Whitmires spent $1.5 Million proving they were right and the appeals court stated Lannie Whitmire was falsely imprisoned by the executive members of the NCHA, including their lawyer who was in the same class as Mrs. Whitmire. Isn’t that a conflict of interest on the part of the lawyer and the NCHA? After all, it was proven in court that a signed complaint – which is required by NCHA, never existed and was never produced or on file with the NCHA!!

    3. To verse yourself on the Dufurrena’s legal woes in court, perhaps you should read the Minshall lawsuit and the Vogel lawsuit and write me your opinion! Both cases allege fraud on the Dufurrena’s behalf. Fraud against NCHA members and the public.

    4. According to AQHA they have a reciprocal rule with the NCHA which states that if your suspended from either organization, your also suspended from the other. Why isn’t Dufurrena and his family also suspended from the AQHA? According to Chad Pierce at AQHA, “if your suspended, you can’t transfer horse papers.” Since Brandon was suspended, how is that possible?

    5. Since you broached the subject about the Dufurrena’s and forfeiture of winnings absent of an NCHA rule to govern that – how is it possible for Janie Vogel to be placed on 3 years probation for allegedly aiding and abetting the Dufurrena’s in violating NCHA non-pro rules when she had no control over whose name the Dufurrena’s switched the horses name into. After all, the NCHA allowed Ed Dufurrena to change the ownership

    Records for Stevie Rey Von right before the NCHA finals which eliminated the Vogels from receiving 49% of the horses winning from either Ed, Brandon, or Rieta Dufurrena. For the record the Vogels have never received one dime of earnings from the Dufurrena’s for any horse the Vogels had a 49% interest in or any other the Dufurrena’s showed for them for that matter. Janie Vogel has no clue what a non pro is.

    6. How is it possible for the NCHA to sit idly by and allow a trainer, Director, and member of the NCHA to operate within an organization using unregistered dba’s Or assumed names which are in direct violation of Texas business laws?

    7. Concerning the anonymous gripe, please let me remind you that Glory Ann Kurtz was at one time performing a cost analysis comparison of your IRS 990’s and needed the salary of Rick Ivey. She was told that she could have the information but she would be required to sign a non-disclosure agreement which would prevent her from telling anyone. She refused and the NCHA sued her. For the record, the NCHA is a 501 (C) 3 Nonprofit Corporation. It seems there are some within the NCHA that think they actually own it, when they don’t and never can. This type of action is habitually used by the NCHA to punish its members. That’s why folks are reluctant to sign their name to a complaint.

    8. The NCHA should be an open and transparent corporation. Why all the secrets, and why isn’t it?

    9. Since you didn’t broach the subject, has the NCHA been found to be manipulating financial statements and is this the reason for the reduction in METF funding?

    10. Why did Phil Rapp see the necessity to hand pick a 3 panel committee to oversee the previous panel who had already voted to suspend the Dufurrena’s for a longer period of time?

  14. I congratulate the letter I just read. It is so true. However, I am bothered that the composer of such a good strong letter chooses not to sign the same. I am not afraid to agree with the letter in total and let all readers know who I am.Thank you.

    • True words Midge Ames! NCHA hierarchy is incredibly corrupt. Janie Vogel was punished by a bunch of misogynist, good ‘ole boys. This organization had better step up their integrity game – NCHA is still in the stone ages in terms of the lack of women in executive, judging & training positions. Always giving passes to the male trainers – accountability is not their favorite word!

I can understand the need for anonymity with the NCHA’s track record for bullying and revenge against those who ask questions or speak truths. As I consider Phil Rapp as somewhat of a friend and having a good heart, I cannot excuse his poor judgment in this matter. Sorry Phil, but we are all accountable for our actions. Hate to say it, but some of your decisions have not been presidential. I’m sure your intentions were good, but it may be time to step down.

  18. Wow, how sad! What a mess our association has become! I applaud whoever wrote the letter, and I’m sure it wasn’t easy. I can easily understand the need for anonymity and think it was probably a wise choice, as we are in an era of revenge and retaliation. I agree wholeheartedly with the content of the letter, but wish it didn’t have to be written. I know Phil and consider him to be an honorable person. I’m sure he was well intentioned, but used poor judgement in his decisions. However, when someone in a position of power uses bad judgment , no matter the purity of their intent, must recognize their errors and be accountable for their actions. In this case, I think Phil should acknowledge his mistakes and step down as our president. Thank you to glory Ann for publishing it.

  19. For those of you complaining about anonymous, unsigned, unnamed, name withheld or any other unidentified person, pay attention to this. It comes straight from the NCHA Rule Book so think twice before you call someone a coward or suggest to anyone else to disregard anything they have to say.

    STANDING RULE 39. No person shall make a derogatory remark, nor take or threaten to take, adverse action against any NCHA sponsor, its agent, servants or employees, relating in any manner to the sponsor’s involvement with the NCHA or an NCHA event. Any person who violates this rule is subject to disciplinary ac- tion and is also responsible to the NCHA for any loss or damage caused by a violation of this rule.

  21. I can understand a letter like this not being signed. The accuracy of it is not the whole issue. There would be repricusions from other members.
    Bill and I turned someone in years ago for horse abuse in the practice pen. The abuse was severe, Over the top and bloody.
    The person was reprimanded but was also told who turned them in.
    Never again for us.

    • Kris, I don’t think the Grievance Committee does that any longer. They’ve been pretty tight-lipped about all of these recent grievances. They also will not release the names of those serving on the committee for the very same reason – confidentiality.

      But on the other hand, I definitely see why some would not want to identify themselves because of Standing Rule 39 in NCHA Rule Book.

  23. Boy, these letters are great except for Mr. Tynes, Yes he is a lawyer but not a very good one , just one of the good old boys every who is on top he`s with them,We need someone like Pres. Trump to straighten this out or like ALAN STEEN , SOMEONE SHOULD ASK HIM why he quit, he really could put a light on this, but when he left they made him sign a agreement not to say anything , chichen sh–. we need some one to replace Phil but who, as for Lewis Ray he was helping for nothing because that`s all he`s worth, Know he`s drawing $90,000.00 for his time wasted money not a good person ask around .
